Welcome to Bobtail Enterprises, LLC. By using this website or contacting us for services, you agree to the following Terms & Conditions. These terms summarize and reflect the rules contained in our formal Service Agreement and General Terms & Conditions for Services.

1. Services Provided

Bobtail Enterprises, LLC. We provides forestry, fuels reduction, tree thinning, tree removal, brush management, and related land-management services.
All work performed for Client is governed by a written Quote and the official General Terms and Conditions for Services.

2. Estimates & Quotes

  • All quotes are estimates based on conditions observed during our site visit.

  • Actual costs may vary depending on time, materials, equipment, access, or changes in scope.

  • Every quote is valid for 30 days unless stated otherwise.

  • Work begins only after the Client signs or accepts the quote.​

 
3. Fees, Expenses & Payment​​

  • The Client agrees to pay the fees listed in the approved quote.

  • Additional expenses such as dump fees, hauling, recycling charges, and permits may apply.

  • Invoices are due within 30 days of the invoice date.

  • Late payments accrue 1.5% interest per month.

  • We may pause or stop work if outstanding invoices are not paid.

Accepted payment methods: check, cash, or any other method we approve.

 
4. Client Responsibilities

To ensure safe and efficient work, the Client must:

  • Provide safe access to the property and work area

  • Disclose any hidden hazards (underground utilities, septic, irrigation, etc.)

  • Secure pets and remove personal belongings from work zones

  • Obtain burn permits when applicable (unless arranged differently in the quote)

Failure to disclose hazards may result in additional charges or delays.

5. Scheduling & Delays

​Work may be rescheduled due to:

  • Weather

  • Equipment availability

  • Fire restrictions

  • Safety concerns

  • Emergencies or other unavoidable conditions

We make every reasonable effort to keep projects on schedule.

6. Warranty

We guarantee that services will be performed by trained personnel using accepted industry practices.
However, due to the nature of forestry and vegetation management:

  • We do not guarantee specific outcomes, such as wildfire prevention, regrowth behavior, or long-term tree health.

  • Remedies for service issues are limited to re-performing the work or issuing a refund for non-conforming services.

This follows the official contract’s warranty terms.

7. Liability Limitations

To the fullest extent allowed by law:

  • We are not liable for indirect, incidental, special, or consequential damages (such as lost profits, inconvenience, or property value changes).

  • Our total liability will never exceed the amount the Client paid for the service.

This section matches the limitations in your official legal agreement.

8. Indemnification

The Client agrees to indemnify and hold Bobtail Enterprises harmless from losses or claims arising from:

  • Client’s negligence

  • Client-caused hazards

  • Misrepresentation

  • Undisclosed property risks

  • Damage resulting from conditions outside our control

This language is reflected directly from the law-firm-prepared contract.

9. Cancellations & Termination

  • Either party may cancel work with reasonable notice.

  • Last-minute cancellations may incur a mobilization fee.

  • We may terminate a project for non-payment or a material breach of agreement.

  • Upon termination, the Client must pay for all work performed up to that point.

10. Use of Website

By using this site, you agree not to:

  • Copy content without permission

  • Attempt to disrupt or damage the site

  • Use the site for unlawful purposes

Website information is provided “as is” and may change at any time.

11. Privacy

Any personal information submitted through forms, email, or quote requests is handled in accordance with our Privacy Policy (available upon request or linked on the site).

12. Governing Law

All services, quotes, and agreements are governed by the laws of the State of Montana, and disputes fall under the jurisdiction of Lincoln County, MT.
